In a strongly worded decision, a federal judge in Texas has granted a habeas corpus petition filed by an asylum seeker and his 5-year-old son and has ordered their release from immigration custody.
U.S. District Judge Fred Biery, of the Western District of Texas in San Antonio, wrote in the decision that the case began as a result of a “poorly executed effort to enforce a daily quota of deportation.” He said the deportation and detention of the father and the minor child had to be carried out according to proper legal procedure.
The habeas corpus petition was filed by Adrian Conejo Arias and his minor child, identified as L.C.R., with the father as the parent and guardian of the minor child. The father and the minor child sought basic due process and protection as provided for by the habeas corpus.
In the decision, Judge Biery identified several government officials as respondents in their official capacity, including Homeland Security Secretary Kristi Noem, Attorney General Pamela Bondi, acting ICE Director Todd Lyons, acting Executive Office for Immigration Review Director Daren Margolin, and a “John Doe” identified as the warden of the Dilley Immigration Processing Center in Dilley, Texas.
In the opinion, the judge pointed out the standards of the Fourth Amendment regarding searches and seizures. He was highly critical of the use of administrative warrants, stating that the Constitution mandates an independent judicial officer to review the warrant. He went on to say that the Constitution trumps the detention of Conejo Arias and his son by the administration. He ordered the release of the detainees through an appended judgment.
For those unfamiliar with habeas corpus petitions, these are legal filings made against unlawful detention. In immigration cases, these petitions seek court intervention if the detainees argue that they are being detained without sufficient legal process.
The order stated that the petitioners could go back to their country of origin because of the current state of the US immigration system, whether willingly or not. However, it should be done through a more organized and humane policy than the one that is presently in place.
