President Donald Trump, in conjunction with Donald Trump Jr., Eric Trump, and the Trump Organization, has filed a lawsuit against the Internal Revenue Service and the Treasury Department in federal court in Miami for at least $10 billion in compensation for the disclosure of his tax return documents.
The lawsuit seeks a jury trial against the agencies for failing to maintain the confidential tax documents of President Trump as mandated by law.
In the lawsuit, President Trump claims that his tax documents were improperly accessed by Charles Edward Littlejohn, who worked as a contractor for the IRS. After improperly obtaining access to President Trump’s tax documents, he then shared this information with reporters from various news agencies, including The New York Times and ProPublica. This took place from 2019 to 2020, but for some reason, this disclosure was not flagged for years.
The lawsuit also cites tax privacy laws as mandated by the Internal Revenue Code to obtain compensation for the disclosure of tax documents. This law also allows for damages to be granted to plaintiffs in the event of an improper disclosure of tax documents by any agency or person.
In addition to this, the lawsuit also cites the Privacy Act of the United States for failing to maintain proper safeguards for tax documents in its systems.
The filing claims that the leak is not the sole action of one person but that the agencies’ measures, monitoring, and security practices were inadequate, leading to the leak.
Littlejohn was sentenced to five years in prison in January 2024 after pleading guilty to the offense of the unlawful disclosure of information on tax returns, according to the U.S. Department of Justice.
Treasury has also cited the leak as part of the data protection concern. In a press release on January 26, 2026, Treasury announced the cancellation of all the contracts with Booz Allen Hamilton. The Treasury described Littlejohn as an employee of the company at the time of the leak. The Treasury cited the leak as one of the reasons.
The lawsuit seeks damages, costs, attorneys’ fees, and punitive damages.
