Oregon’s attorney general says National Guard deployments in the state remain on hold as a federal judge set a Friday hearing on whether to dissolve a temporary restraining order.
According to Oregon Attorney General Dan Rayfield, the district court in Oregon scheduled a hearing for Friday on the government’s motion to dissolve a second TRO that currently prevents any Guard deployments in Oregon.
Rayfield said his office will also submit a filing to the U.S. Court of Appeals for the Ninth Circuit urging an en banc review of a panel ruling that stayed an earlier TRO. He noted that timing on the appellate court’s next steps is up to the court.
“For now, National Guard troops still cannot be deployed in Oregon,” Rayfield said.
What’s next: In the Ninth Circuit, the state is asking the full court to take the case en banc and vacate Monday’s stay that paused the first TRO. In the district court, the state will argue Friday that the second TRO should remain in place while the appellate process plays out.
Rayfield said Oregon will continue to press its case to uphold state law and the Constitution.
